ARTICLE 1: PURPOSE - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

The Web site accessible at www.linkbus-alps.com (hereinafter "the Site") is published by SARL RESALP LINKBUS, a limited liability company with its registered office at 9245 Avenue du Général de Gaulle, Quartier de la Gare, 05100 BRIANCON, registered with the GAP Trade and Companies Register under number 507 701 381 (hereinafter "RESALP LINKBUS").

These general terms and conditions govern the terms and conditions for the organization and sale by RESALP LINKBUS of tickets for LINKBUS services, regular coach services between Turin airport and the ski resorts of : Montgenèvre and Serre Chevalier-Briançon. The Turin-Serre Chevalier regular service is authorized by the French Ministry of the Environment, Energy and the Sea (N°2978-2016 and N°3218-2017).

Details of routes, timetables and prices for all services are available on the website at www.linkbus-alps.com.

These terms and conditions also govern the last-mile option, which allows passengers to be driven to the door of their accommodation.

Any order placed on the Site implies acceptance, without reservation, of the entirety of these General Terms and Conditions, which the Customer acknowledges having read.

These General Terms and Conditions, which can be viewed in the "General Terms and Conditions" section of the Website, are the sole contractual document binding the Customer to RESALP LINKBUS. They contain all information relating to the Customer's rights and obligations in connection with the LINKBUS service. An electronic copy of these terms and conditions is automatically sent to the customer with the order confirmation, to the e-mail address indicated at the time of ordering. A paper or electronic copy may be sent to the Customer at any time by simple request sent to the address mentioned in the present article.

RESALP LINKBUS reserves the right, at any time, without prior notice, and at its sole discretion, to modify all or part of these terms and conditions, each order nevertheless remaining governed by the version of the terms and conditions in force at the time of its validation.

The possible nullity or unenforceability of a contractual clause shall not entail the nullity or unenforceability of the general terms and conditions as a whole, the unaffected clauses remaining fully applicable between the parties.

The temporary non-application of a clause by RESALP LINKBUS shall not constitute a waiver of the other clauses of these terms and conditions.

ARTICLE 2: TIMES AND ROUTES

The times and routes indicated on the Site are defined taking into account normal traffic conditions, subject to hazards, accidents and force majeure events that may occur.

RESALP LINKBUS accepts no responsibility for delays due to weather and traffic conditions, including but not limited to snowfall, partial or total road closures, municipal or prefectural traffic bans, or road congestion.

RESALP LINKBUS reserves the right to modify or cancel the itinerary or timetable of a trip in the event of force majeure, and in particular in the event of a municipal or prefectural travel ban, notably due to weather conditions.

In this case, RESALP LINKBUS will inform the customers concerned by the cancellation or modification by SMS, and/or by e-mail to the number and address indicated at the time of the order, no later than 30 minutes after the departure time initially scheduled.

In the event of cancellation of the trip by RESALP LINKBUS or a delay exceeding one hundred and twenty minutes (120 mn), RESALP LINKBUS will offer the customer a choice between one of the following three options:

  • Cancellation and refund of paid order
  • Acceptance of the changes made and continuation of the order under the new conditions
  • Exchange for a subsequent trip under comparable conditions, at no extra charge.

Boarding the replacement coach offered by RESALP LINKBUS constitutes a waiver of any claim for reimbursement or exchange.

If the Customer is unable to board the replacement coach or if RESALP LINKBUS does not offer a replacement solution, the Customer must inform RESALP LINKBUS of his choice by telephone or by e-mail, at the numbers and e-mail addresses indicated in Article 1 hereof, within fourteen (14) days of the date of the cancelled journey or the journey delayed by more than 120 minutes.

Failing this, no exchange or refund can be requested. In the event of an acceptable refund request, the refund will be made within fourteen (14) days of the Customer's request at the latest.

All references on the Site to flight schedules serving Turin airport or any other airport are provided for information purposes only, without any guarantee from RESALP LINKBUS as to their accuracy or compliance by the airlines.

RESALP LINKBUS therefore declines all responsibility and will not make any reimbursement in the event that the Customer is unable to be present on the booked journey due to a delay or a change in flight schedule.

ARTICLE 3: LUGGAGE

Buying a ticket on the RESALP LINKBUS website entitles you to transport:

  • one piece of hand luggage per person, which may be carried in the coach's passenger compartment, provided that it complies with the dimensions of the stowage space provided and remains in the stowage space for the duration of the journey;
  • baggage weighing up to 25 kilos in the hold, must be labelled and bear the name, telephone number and address of its owner
  • a pair of skis and poles OR a snowboard per person.

Hand luggage remains in the sole custody of the customer at all times.

The customer undertakes to inform RESALP LINKBUS of the presence of precious or fragile objects (such as jewelry, valuables, works of art, scientific or technical equipment, etc.) at the time of booking, or a little later to the driver at the time of boarding.

If necessary, the driver may ask the Customer to remove the said items from the luggage and carry them with him in the passenger compartment.

RESALP LINKBUS shall not be held liable in the event of failure to report such items, or in the event of the Customer's refusal to remove them from the hold baggage, notwithstanding any provisions to the contrary in these GCS.

In any case, RESALP LINKBUS declines all responsibility for loss, theft or damage to luggage, except in the event that this event is directly and exclusively attributable to a fault on the part of RESALP LINKBUS.

In the event of a claim, the passenger must submit a written claim to the driver at the time of discovery of the damage.

All claims must be confirmed by registered letter with acknowledgement of receipt, no later than three (3) months after the date of the trip during which the alleged defects occurred.

All claims must mention :

  • the date and time of the trip,
  • stop boarding the baggage concerned,
  • stop unloading the baggage concerned,
  • order number
  • a precise description of the disorders observed,
  • invoices for lost or damaged goods
  • RESALP LINKBUS's alleged fault and the relevant supporting documents.

Any claim that is incomplete or out of time will be automatically rejected. In such cases, the Customer shall not be entitled to claim any compensation whatsoever.

RESALP LINKBUS undertakes to inform the Customer of the action taken on the complaint within one (1) month, and to inform the Customer of its final response at the latest within three (3) months of the complaint being sent.

In the event of loss of or damage to baggage, provided that the customer's claim is admissible and that the customer proves that the damage is the direct and exclusive result of a fault on the part of RESALP LINKBUS, RESALP LINKBUS will compensate the customer, upon proof of the loss or damage and of the contents of the baggage, up to a maximum of 460 euros (including VAT) per baggage item.

ARTICLE 4: ORDERING

  • 4.1 Validation and modification

The Customer determines the dates and times of his/her trip on the Site. When placing an order, he/she indicates his/her surname, first name, address, telephone number and e-mail address, and guarantees the accuracy of the information provided.

Before clicking on the "confirm order" button, the Customer can check the details of his order, its total price including processing costs, and return to the previous pages to correct any errors or modify his order.

The customer's basket must be validated before the order can be validated.

Any order made through the Site, and whose payment has been validated by RESALP LINKBUS, guarantees the availability of a place on the journey booked.

If applicable, the Customer will receive a confirmation of the order and his electronic ticket allowing him to embark, by e-mail, at the address indicated at the time of the order.

RESALP LINKBUS cannot be held liable for any reason whatsoever in the event of an incorrect e-mail address being provided at the time the order is placed.

No refunds will be made unless RESALP LINKBUS expressly agrees.

Orders may be modified up to 7 days before the initially scheduled departure time, subject to a surcharge of five euros (€5 inc. VAT) per ticket.

Tickets are non-cancellable and non-refundable.

Tickets are nominative, and may under no circumstances be transferred or assigned by the customer.

Any ticket holder whose identity differs from that indicated at the time of ordering may be refused boarding, without refund or compensation for any reason whatsoever.

Tickets expire on the date of departure and cannot be resold under penalty of prosecution.

  • 4.2 Shrinkage

In accordance with article L221-16 9°) of the French Consumer Code, the Customer acknowledges that the right of withdrawal provided for in article L221-18 of the same Code does not apply to bookings made on the www.linkbus-alps.com website, with regard to passenger transport services.

In application of the aforementioned texts, the Customer expressly waives his right of retraction, the order therefore being definitive as soon as payment has been validated.

ARTICLE 5: FINANCIAL CONDITIONS

Prices are indicated on the Site in euros, all taxes included (€ VAT included).

RESALP LINKBUS is free to set the fare. It ranges from twenty-five euros all taxes included (€25 inc. VAT) to seventy-nine euros all taxes included (€79 inc. VAT), depending on the time of year and the occupancy rate.

The price is the current price indicated on the Site on the day of the order.

In the event of a promotion, RESALP LINKBUS undertakes to apply the promotional price to all orders placed during the period of the promotion, provided that the Customer complies with the conditions laid down for the benefit of the said promotion. The date taken into consideration for the benefit of a promotion is the date of the order, not the date of the journey booked. Apart from the promotions provided by RESALP LINKBUS, the Customer may not request any discount whatsoever.

RESALP LINKBUS reserves the right to modify its prices at any time, while guaranteeing the customer the application of the price in force on the day of the order, subject to availability.

The price is payable in full after confirmation of the order and is paid by credit card. The Site is equipped with a secure online payment system enabling the Customer to encrypt the transmission of his/her bank details.

ARTICLE 6: SAFETY

The customer is informed that it is compulsory to wear a seatbelt inside RESALP LINKBUS coaches throughout the journey, including when stationary, as long as the vehicle's engine is switched on.

More generally, the Customer undertakes to comply with all safety instructions given on board by the driver, to remain seated and buckled up throughout the journey, to behave in a manner respectful of good morals and other passengers, not to get off or attempt to get off outside the scheduled stops on the journey, and more generally to refrain from any behavior likely to harm the physical integrity or property of other passengers, the driver and/or RESALP LINKBUS.

The customer may be held liable and prosecuted for any failure to comply with safety instructions.

The customer is liable for any damage caused to RESALP LINKBUS equipment and materials. Where applicable, the customer undertakes to compensate RESALP LINKBUS for the cost of repairing the equipment concerned, at RESALP LINKBUS's first request.

For the duration of the journey, the customer undertakes to carry proof of purchase of the ticket on the www.linkbus-alps.com website, as well as a valid form of identification.

Failing this, RESALP LINKBUS does not guarantee the completion of the journey, and declines all responsibility in the event of customs control.

For all underage passengers, the surname, first name, address and telephone number of the parents or guardians must be given when the order is placed. Passengers under the age of 18 must be accompanied by their parents or guardians, or carry written authorization from their parents or guardians, together with proof of their parents' or guardians' identity. Otherwise, boarding is not guaranteed. If the minor is accepted for boarding despite the absence of written authorization, the name, address and telephone number of the parents or guardians and of the person with whom the minor will be staying at the destination must be given to the driver.

Dogs and pets are welcome, provided they are kept on a leash or in a cage and muzzled. However, the driver retains his or her judgement based on the behavior of the animal and the customer, and may refuse access to the vehicle if necessary.

Except in cases of application of the French law n°85-677 of July 5, 1985 relating to traffic accidents, the contractual liability of RESALP LINKBUS for any bodily injury suffered by the Customer shall in no case exceed the sum of 138,000 euros per passenger.

Article 8: Personal information

RESALP LINKBUS undertakes not to divulge to third parties any information provided by the Customer without his consent. This data is confidential. It is only used to process the order and to reinforce and personalize the communication and product offer reserved for RESALP LINKBUS customers, in particular through newsletters to which the customer has subscribed, as well as to personalize the Site according to the customer's areas of interest.

The processing of personal data, which is kept by RESALP LINKBUS for the sole purpose of administering orders and commercial relations, has been declared to the CNIL under number 1990427.

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to personal data concerning them. To do so, simply make a request online or by post, indicating your surname, first name, address and, if possible, your customer reference, to the address given in this article.

Article 9: Intellectual property

RESALP LINKBUS and its partners are the sole owners of the intellectual and industrial property rights relating to the content of the Site, including but not limited to texts, articles, photographs, videos, logos, drawings, models, trademarks and other graphic or written elements that can be consulted from the Site.

The Customer shall therefore refrain from downloading, reproducing, altering, modifying and/or printing works, trademarks, logos, texts, images, sounds, photos, graphic charts, software, and more generally any information present on the Site that may benefit from protection under Intellectual and/or Industrial Property, and this for purposes other than strictly personal and private.

Any fraudulent use of works protected in this way may render the customer personally liable to the holders of the rights thus infringed.

Article 10: JURISDICTION OF JURISDICTION

The Customer acknowledges that these terms and conditions and all services provided by RESALP LINKBUS are governed by French law, which is exclusively applicable.

Consequently, all questions relating to the validity, performance, interpretation and termination of this contract are governed by French law, and fall within the jurisdiction of the Tribunal de Grande Instance de GAP.
